1. Introduction

Emporia Fitness Club is an online personalized coaching service exclusively for women. By using our services, the client agrees to the terms and conditions below, as well as the provisions regarding the protection of personal data, in accordance with the General Data Protection Regulation (GDPR).

2. Definitions

  • Service: The provision of online coaching that includes personalized workout plans, nutritional tips, and health and wellness guidance, provided by a multidisciplinary team in the areas of health, fitness, and wellness.

  • Client: The person who signs up to use the services and voluntarily provides information about her health status, goals, and physical limitations in order to receive personalized coaching.

3. Plans, Payments, and Renewal

3.1 Types of Plans

Emporia Fitness Club offers three coaching plans:

- Essential Plan
- Movement Plan
- Evolution Plan
- Premium Plan
The e-book “Mente em Movimento” is available for individual purchase or can be acquired at a discount when bundled with a coaching plan.

3.2 Payment

  • Payment must be made before coaching begins.

  • Plan prices are available on the website and via official Emporia Fitness Club communications on WhatsApp.

3.3 Renewal

  • Plans renew automatically unless canceled at least 5 business days prior to the renewal date.

  • Renewal payments will be processed using the same payment method as the original.

3.4 Refund Policy

  • No refunds are issued after joining a plan.

  • In specific cases (e.g., proven health issues), Emporia Fitness Club may consider temporarily suspending the plan.

 

4. Coaching Process

4.1 Coaching Steps

  • Initial Assessment – The client fills out a detailed questionnaire and submits photos for analysis.

  • Plan Creation – 100% personalized support including training and nutritional guidance.

  • Plan Delivery – Within a maximum of 48 hours, the Emporia team sends the plans via MyEMPORIA app, adapted to individual needs.

4.2 Communication

  • WhatsApp and MyEMPORIA app are the main support and interaction platforms.

  • Response time may vary up to 24 hours depending on demand.

 

5. Responsibilities of Emporia Fitness Club

Emporia Fitness Club commits to providing personalized workout and nutritional plans based on information provided by the client, aiming to promote health, well-being, and satisfying results. However, it is important for the client to understand that:

  • The guidance offered does not replace medical consultations or assessments by qualified healthcare professionals, especially in the presence of pre-existing medical conditions.

  • The client is responsible for disclosing any health conditions that may affect their workout or diet.

  • Emporia Fitness Club is not liable for health issues or complications resulting from following the workout or nutrition plans.

 

6. Client Responsibilities

By joining Emporia Fitness Club, the client agrees to:

  • Provide accurate information about their health status, physical limitations, medical history, allergies, physical activity level, and other relevant data.

  • Follow the guidance provided by fitness professionals responsibly and within personal limits.

  • Consult a doctor or healthcare provider before starting any workout or diet plan, especially if there are pre-existing conditions or health concerns.

 

7. Limitation of Liability

Emporia Fitness Club is not responsible for:

  • Injuries, physical or psychological harm resulting from following the workout or nutrition plans.

  • Negative results from applying the provided plans or tips, as individual responses to training and diet programs vary.

  • Health complications that may arise even when guidance is followed properly.

The client acknowledges they are solely responsible for safely following the guidance, respecting their limits, and any negative outcome cannot be attributed to Emporia Fitness Club.

 

8. Personal Data Protection (GDPR)

In compliance with the General Data Protection Regulation (GDPR), the privacy and security of client data is a top priority. The following explains how personal data is handled:

  • To provide personalized service, we collect personal data such as name, age, health history, physical activity level, wellness goals, and other relevant data.

  • Data will be used exclusively to create workout plans, provide nutritional guidance, and monitor progress.

  • Data is securely stored and protected in accordance with applicable data protection laws.

  • Clients have the right to access, correct, delete, or restrict the use of their data, as well as the right to data portability. These rights can be exercised by contacting Emporia through the designated channels.

  • Appropriate measures are in place to protect personal data from unauthorized access, alteration, or disclosure.

 

9. Use of Content and Images

The client acknowledges that any content created or provided by fitness professionals, including workout plans, videos, photos, and other materials, is the intellectual property of Emporia Fitness Club. The client agrees not to reproduce, distribute, or alter such content without explicit permission.

Additionally, by submitting photos or other graphic materials for progress tracking or assessment, the client authorizes their use for coaching purposes and promotional content, if permission is explicitly requested beforehand.

Emporia Fitness Club may, with prior request, ask the client to authorize the use of their images for marketing purposes such as showcasing results on digital platforms, social media, or promotional materials. The client has full freedom to accept or decline, without affecting their service.

Emporia is committed to treating all images confidentially and securely, in line with GDPR, and no image will be used for advertising without the client's explicit consent.

 

10. Refund Policy

Emporia Fitness Club does not offer refunds for services, as personalized coaching, workout plans, and nutritional guidance are delivered immediately upon joining and are non-refundable. By starting the coaching plan, the client irrevocably agrees to this policy.

 

11. Service Cancellation and Suspension

11.1 Cancellation

  • Clients can cancel their plan at any time, but no refunds will be issued for unused time.

  • Cancellation must be requested at least 5 business days before renewal.

11.2 Pause in Coaching

  • In special cases (e.g., pregnancy, injuries), clients may request a temporary suspension of their plan, subject to team approval.

11.3 Inactivity

  • If the client is unresponsive, the plan will remain active until the contracted period ends.

 

12. Partnerships and Exclusive Benefits

12.1 Access to Partnerships

Emporia Fitness Club offers clients a network of carefully selected partners who complement our commitment to physical, emotional, and mental well-being. These include services in psychology, health, aesthetics, and overall wellness, with special conditions exclusive to Emporia clients.

12.2 Use of Partnerships

Benefits from partnerships are exclusive to active clients with valid plans and cannot be transferred to third parties or used after the coaching period ends, unless otherwise agreed with the partner.

12.3 Partner Service Responsibility

Emporia Fitness Club is not responsible for services provided directly by partners. Responsibility lies with the respective professionals or entities. However, we commit to maintaining partnerships only with qualified professionals aligned with our values.

 

13. Changes to Terms and Conditions

Emporia Fitness Club reserves the right to change these Terms and Conditions at any time without prior notice. Any changes will be published on this page and will take immediate effect upon publication.

 

14. Termination

The client may cancel the service at any time with prior notice.
Emporia Fitness Club also reserves the right to terminate services if any clause in this agreement is violated.

15. Governing Law

This contract is governed by the laws of the country in which Emporia Fitness Club is registered. In the event of a dispute, the parties agree that the courts of Lisbon will have jurisdiction.

 

16. Acceptance of Terms

By beginning the online coaching plan with Emporia Fitness Club, the client automatically agrees to all terms and conditions outlined here, including the no-refund policy, the limitation of liability, and the authorization for image use as described.
